Terms and Conditions

1. Acceptance of Terms

By accessing and using Catwa ("the Platform", "we", "us", "our"), operated by Noimos (Pvt) Ltd, you agree to be bound by these Terms and Conditions, our Privacy Policy, and our Return & Refund Policy. If you do not agree with any part of these terms, you must not use the Platform.

These terms govern your use of all Platform services, including but not limited to: model and talent profile management, project matching, booking services, marketplace purchases, educational courses, fitness programs, and any other services offered through the Platform.

2. Eligibility

You must be at least 18 years old to create an account and use the Platform. By registering, you confirm that:

  • You are at least 18 years of age.
  • The information you provide during registration and profile setup is accurate, current, and complete.
  • You will maintain and update your information to keep it accurate.
  • You have the legal capacity to enter into a binding agreement.

Users under the age of 18 who wish to appear in modelling or talent-related work must have a parent or legal guardian register on their behalf and maintain oversight of the account. The guardian is fully responsible for the minor's use of the Platform.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

  • Create only one personal account (you may operate multiple business organizations under the same account).
  • Notify us immediately of any unauthorized access or use of your account.
  • Not share your login credentials with any third party.
  • Accept responsibility for all activities that occur under your account.

We reserve the right to suspend, restrict, or terminate accounts that violate these terms, are inactive for extended periods, or pose a security risk. Terminated accounts and their associated data will be handled in accordance with our Privacy Policy.

4. User Types & Roles

The Platform supports multiple user types, each with specific rights and responsibilities:

  • Models & Talents: Individuals who create portfolios, apply to projects, accept bookings, and offer their professional services. Models retain full control over their profiles, photos, and which opportunities they accept.
  • Businesses & Clients: Organizations or individuals that post projects, search for talent, make bookings, and hire models/talents for professional engagements.
  • Service Providers: Professionals offering salon services, photography, fitness instruction, studio/location rental, and other related services through the Platform.
  • Buyers: Users who purchase products (fashion magazines, costumes, accessories) or subscribe to paid courses through the Platform's marketplace.

Users may hold multiple roles simultaneously (e.g., a model who also operates a photography business).

5. User Content

You retain ownership of all content you upload to the Platform, including photos, videos, descriptions, and other materials ("User Content"). By posting User Content, you grant Catwa a non-exclusive, worldwide, royalty-free license to:

  • Display and distribute your content within the Platform.
  • Use your content for Platform promotion and marketing (e.g., featured profiles, social media highlights), unless you opt out.
  • Generate thumbnails, compressed versions, and blur placeholders of your images for performance optimization.
  • Cache and serve your content through content delivery networks.

You must not upload content that:

  • Is illegal, obscene, defamatory, threatening, or violates any applicable law.
  • Infringes on the intellectual property, privacy, or publicity rights of any third party.
  • Contains explicit or sexually suggestive material (enforced via automated NSFW detection).
  • Is deceptive, misleading, or misrepresents your identity or qualifications.
  • Contains malware, viruses, or harmful code.

We reserve the right to remove any content that violates these terms, without prior notice. Repeated violations may result in account termination.

6. Code of Conduct

All users must interact respectfully and professionally. The following actions are prohibited and may result in immediate account suspension or termination:

  • Harassment, bullying, intimidation, or discrimination of any kind.
  • Fraud, scams, phishing, or impersonation of other users or entities.
  • Soliciting users for activities outside the Platform to circumvent our terms or fees.
  • Spam, unsolicited advertising, or repetitive unwanted messages.
  • Attempting to access other users' accounts or data without authorization.
  • Manipulating reviews, ratings, or feedback systems.
  • Using the Platform for any unlawful purpose.

Businesses and clients must provide accurate project descriptions, compensation details, working conditions, and scheduling information. Misleading job posts or false promises are grounds for account termination.

7. Bookings & Services

The Platform provides booking and scheduling features for models, talents, service providers, and businesses. By using the booking system:

  • Service providers set their own availability, packages, pricing, and terms.
  • Clients understand that booking requests are subject to provider approval.
  • Both parties agree to honor confirmed bookings or provide reasonable notice for cancellations.
  • Catwa acts as an intermediary platform and is not a party to the service agreement between provider and client.
  • Disputes between parties should be resolved directly; Catwa may offer mediation but is not obligated to resolve disputes.

Booking cancellation and rescheduling policies are set by individual service providers. Users should review these policies before confirming a booking.

8. Marketplace & Purchases

The Platform may offer a marketplace for purchasing or renting products and services, including but not limited to:

  • Fashion magazines and publications.
  • Costumes and wardrobe items (purchase or rental).
  • Accessories, props, and styling products.
  • Paid educational courses and learning materials.
  • Fitness and wellness programs.

All marketplace transactions are governed by these terms and our Return & Refund Policy. Prices are listed in Sri Lankan Rupees (LKR) unless otherwise stated. We reserve the right to modify pricing at any time.

Product availability is not guaranteed. We make reasonable efforts to accurately describe products and services, but do not warrant that descriptions, images, or pricing are entirely error-free.

9. Payments & Fees

Financial arrangements on the Platform are governed as follows:

  • Direct Arrangements: Financial agreements between models/talents and businesses for project work are solely between those parties. Catwa is not liable for payment disputes arising from such arrangements.
  • Marketplace Purchases: Payments for products, rentals, and subscriptions are processed through the Platform's payment system. All sales are subject to our Return & Refund Policy.
  • Booking Payments: Service fees and booking payments are handled through the Platform. Cancellation refunds follow the provider's cancellation policy and our return policy.
  • Subscriptions: Recurring subscriptions (fitness programs, courses, premium features) will automatically renew unless cancelled before the renewal date.

The Platform may charge service fees or commissions on certain transactions. These fees will be clearly disclosed before any purchase or booking is confirmed.

All payments are subject to applicable taxes as required by Sri Lankan law.

10. Intellectual Property

All Platform content, features, and functionality (excluding User Content) - including the Catwa name, logo, design, code, and trademarks - are owned by Noimos (Pvt) Ltd and protected by intellectual property laws.

You may not copy, modify, reverse-engineer, distribute, or create derivative works from any Platform materials without written permission. Educational course content, fitness programs, and other paid materials are licensed for personal use only and may not be redistributed.

11. Profile Verification

The Platform includes a verification system for profiles and organizations. Verification indicates that a profile has been reviewed by our team but does not constitute an endorsement, guarantee of identity, or certification of professional qualifications.

Users whose profiles are rejected may re-submit after addressing the reasons for rejection. Verified profiles that are subsequently edited may be placed back under review.

12. Limitation of Liability

The Platform is provided "as is" and "as available" without any warranty, express or implied. To the fullest extent permitted by applicable law:

  • Catwa is not liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of (or inability to use) the Platform.
  • We do not guarantee the accuracy, quality, safety, or legality of any user content, profiles, listings, or services offered through the Platform.
  • We are not responsible for the conduct of any user, whether online or offline.
  • We do not guarantee uninterrupted or error-free service.
  • Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

13. Dispute Resolution & Governing Law

These Terms are governed by the laws of Sri Lanka. Any disputes arising from or related to these Terms or use of the Platform shall be resolved through:

  1. Informal Resolution: Users should first attempt to resolve disputes through direct communication or by contacting our support team.
  2. Mediation: If informal resolution fails, disputes may be referred to mediation under the Mediation Boards Act of Sri Lanka.
  3. Jurisdiction: Any legal proceedings shall be brought exclusively in the courts of Sri Lanka.

14. Account Termination

You may deactivate or delete your account at any time through Account Settings or by contacting us. We may terminate or suspend your account:

  • If you violate these Terms or any applicable laws.
  • If your account is used for fraudulent or harmful activities.
  • If required to do so by law or legal process.
  • At our sole discretion, with or without cause, upon reasonable notice.

Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including intellectual property, liability limitations, and dispute resolution) will continue to apply.

15. Changes to Terms

We may update these Terms at any time. When we make material changes, we will notify registered users via email or an in-app notification. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

We encourage you to review these Terms periodically. The "Last Updated" date at the top of this page indicates when the latest revision was made.
